Prof. Kofi Abotsi Urges Ghana Bar Association to Reflect on Governance Role Amid Leadership Election

Professor Kofi Abotsi, Dean of the University of Professional Studies, Accra (UPSA) Law School, has called on the Ghana Bar Association (GBA) to evaluate its role in the country's governance as it prepares to elect new leaders. He noted that for the past 20 years, the GBA has grappled with the question of whether to be an active participant or remain passive in governance.
On his X platform, Abotsi emphasized that it is surprising the GBA has struggled with this dilemma, considering it is the only private association explicitly recognized in the constitution and designated with important constitutional duties.
Ghana is internationally recognized for the strength of its justice system, which is bolstered by the judiciary's independence and the high quality of judicial rulings. Dame highlighted his tenure as Attorney-General, noting the judiciary's demonstrated independence through significant rulings that involved the State, despite facing a few adverse decisions himself.
He asserted that judges should view themselves not as adversaries of the public or government but as uphold the law, especially when the government acts within its authority. Moreover, he advocated for the judiciary to adopt a practice of open justice, suggesting that publishing and explaining judgments and increasing access to courts through broadcasting are essential.
