Body by Design rushes to court to challenge closure after client's death

Lucy Wambui, the wife of businessman Francis Ng'ang'a, was confirmed dead at The Nairobi Hospital where she was admitted after developing complications; her death prompted the authorities in the city to shut down the cosmetic clinic
The facility, however, filed a suit in the court challenging the closure, citing a lack of evidence to directly link it with the deceased's death
Body by Design, which allegedly performed a tragic cosmetic surgery on a client, has now moved to court to challenge the Kenya Medical Practitioners and Dentists Council (KMPDC)'s move to close the facility.
The deceased is Lucy Wambui, the late wife of prominent businessman Francis Ng'ang'a.
Omnicare Medical, through their Advocates Sophie Nekesa and Danstan Omari, sued the council and the Nairobi county Director of Health, saying that they are apprehensive that they might be blamed for the death of Wambui without a complete probe.
"There is apprehension that the death of the patient might be attributed to the applicant even though there are no official postmortem results that have been shared with the applicant. The 1st respondent (KMPDC), relying on random, unreliable and sensational social media posts, wrote to the applicant that they would be coming to the facility on the 31st day of October 2024. In the afternoon of the said date, the said respondent wrote to the facility requesting patient information and academic credentials of the facility staff that attended to the said patient", their application states.
