La Habra Heights church sues city, accuses it of harassment over noise issues

A La Habra Heights church has filed a federal lawsuit against the city of La Habra Heights, its city manager and a resident, accusing them of harassment over noise issues and of violating its First Amendment rights.
The lawsuit — filed by World Aflame Tabernacle, which rents the Hillcrest Congregational United Church of Christ, 2000 West Road, La Habra Heights — said City Manager Fabilola Huerta and La Habra Heights resident Juan Garcia, who also was sued, disrupted worship services by taking videos and pictures of the service and accusing the church of violating health orders.
“This is just pure harassment,” Mariah Gondeiro, attorney for the church, said of the city and Garcia’s actions.
“The city has levied fines against the church even though they have been investigated by the Los Angeles County Health Department and Los Angeles County Sheriff’s Department and both entities found they were in compliance,” Gondeiro said.
Gondeiro said the city eventually filed five noise citations against the church and fined it $3,000. No violations of the county’s health orders were filed.
However, La Habra Heights City Attorney Michael Maurer said he told the church’s attorneys in an email he sent to them on Oct.7 the citations and fines were withdrawn.
“We wanted to work out a process moving forward … to produce a solution where they can have services outdoor at a reasonable volume,” Maurer said. “We’re trying to work collaboratively.”
